Corrective measures as alternative tools to administrative sanctions: A methodological proposal

In Peru, public service regulatory agencies have traditionally adopted command-and-control schemes that prioritize the correction of regulatory non-compliance through sanctions rather than using less invasive mechanisms. This approach has led to a deterioration in the relationship between the State and regulated companies, as well as a contradictory increase in the rate of non-compliance with regulatory obligations in some sectors. This paper analyzes the deterrent capacity of corrective measures as an alternative to sanctions and proposes a predictable methodological framework for their application.
