    Delito de acoso sexual basado en la orientación sexual como manifestación de la discriminación

    El reciente Decreto Legislativo 1410 incorpora cuatro delitos al Código Penal peruano, conductas que deberían haber estado sancionadas desde hace mucho tiempo pero que han formado parte de las manifestaciones de violencia que se normalizan en nuestra sociedad. El acoso, acoso sexual, chantaje sexual y la difusión de imágenes con contenido sexual han sido conductas comunes por mucho tiempo, generando un contexto de constante violencia contra ciertos grupos en una situación de especial vulnerabilidad. El presente artículo analizará los elementos del delito de acoso sexual descrito en el Decreto Legislativo 1410, así como las posibles implicancias que traerá su criminalización bajo una perspectiva de género. The recent Legislative Decree 1410 incorporates four crimes to the Peruvian Penal Code, these conducts should have been sanctioned a long time ago but they are part of the manifestations of violence normalized in our society. Harassment, sexual harassment, sexual blackmail and the dissemination of images with sexual content have been common behavior for a long time, generating a context of constant violence against certain groups in a situation of special vulnerability. This paper will analyze the elements of the crime of sexual harassment described in Legislative Decree 1410 as well as the possible implications of its criminalization from a gender perspective.

    The eternal pandemic. Analysis of Legislative Decree No. 1470

    El estado de emergencia debido al SARS-CoV-2 ha supuesto un nuevo reto para las medidas de protección en los casos de violencia contra la mujer. Los derechos a la integridad personal y la vida de la mujer necesitan ser adaptados para ser efectivos durante la pandemia, pues los casos de violencia se incrementaron debido a las nuevas ventajas y los estimulantes que tiene el agresor de cometer el delito. Por tal motivo, el presente artículo tiene como objetivo analizar si el Decreto Legislativo n.o 1470 satisface esas exigencias. Con dicho propósito, se procederá a una conceptualización de los derechos humanos y la violencia contra la mujer en el Perú. Luego, se delimitarán la ley que regula estas medidas y el decreto materia de análisis. Finalmente, se determinará si las soluciones propuestas atienden los derechos en peligro.

    Informality and tax refund in Peru’s intercity passenger ground transport market: An empirical appraisal

    This paper studies whether Peru’s excise tax refund of 30% for fuel purchases has had the effect of increasing formalization in the intercity passenger ground transport market and whether the resulting tax expenditure has been fruitful in increasing investment in vehicles. Based on a partial equilibrium market framework, transport operators are segmented among formal, informal and illegal operators, and a new methodology to measure how the tax refund makes these operators change their market shares is perfected. Evidence shows that the tax refund has worked by augmenting the market share of formal but not informal operators, thus increasing the overall formalization of the passenger transport market. This contradicts the Ministry of Finance impact evaluation asserting that market formalization has not occurred because informal operators did not take advantage of the tax refund and did not convert into formal operators. An epilogue challenges a 2020 government decree establishing a new tax refund no longer intended to reduce informality but rather to reduce accident rates.
